Actually, Greenspan was quite vague, stating, The system cannot function without ... the credit histories of individual borrowers, he said. I should certainly hope that it is maintained. He did not address accuracy and reliability problems, even though his own researchers had found such problems. (See Footnote 27, Chapter 10 on history) credit rating agency There was one problem. At the opening hearing, Assistant Treasury Secretary Wayne Abernathy stunned many Republicans when he testified that the Bush Administration had not yet finalized its position on the FCRA. Therefore, he said, he could not even say whether the Administration supported extension of the law s preemption provision, or whether new safeguards were needed to help consumers fight against identity theft.375 credit rating canada What happened According to sources, political higher ups in the White House discovered through their polling data that the vast majority of Americans cared strongly about such issues as financial privacy, credit report accuracy, and identity theft. The polling data indicated it actually could be risky to endorse industry s wish for preemption without due consideration for consumers interest. In other words, the Bush Administration was still at the drawing board. It was clearly a setback for the industry s fast-track timetable. bad credit mortgage rating Despite the Administration s reticence, Committee Chairman Michael Oxley (R-OH) left no doubt that the committee s priority was reauthorizing preemption. While acknowledging that the committee had many issues to explore, he declared: At the end of the day, this committee will act and will pass legislation reauthorizing the FCRA. That is job No. 1. good credit rating But Rep. Bernie Sanders (I-VT), the Ranking Independent on the subcommittee, said that extensive inaccuracy in credit reports, coupled with growing identity theft, underscored the urgent need for stronger consumer protections. Sanders repeatedly said the place to start was one free credit report per year. Vermont was one of the first states to have a law requiring one free credit report per year. Throughout the House s spring and summer hearings, Sanders continued to harangue committee members about the need for a federal right to a free credit report. credit score rating chart 375Bush Admin. Still Formulating Position; Oxley Vows Action, Privacy Times, Vol. 23 No. 10, May 13, 2003 Challenging Dogma At the early hearings, pro-consumer witnesses quickly challenged industry claims that state laws were bad for commerce, or even that there were uniform national standards. Fordham Law Professor Joel Reidenberg, an author and expert on privacy law, testified that three states with the strongest credit-reporting laws Vermont, Massachusetts, and California ranked 50th, 49th, and 27th in bankruptcies. Moreover, those three States offered the lowest interest rates.376 credit mortgage rating poor Vermont Asst. Attorney General Julie Brill displayed three common ads from Vermont newspapers showing that zero percent financing and instant credit for mortgages, car loans, and personal loans were widely available in the state. 377 good credit rating score As every pro-consumer witness pointed out, it had been the states, and not Congress, that had enacted the best financial privacy, credit reporting, and identity theft protection laws. Preemption would shut off the key source of pro-consumer solutions to real and ever-changing problems, they argued. poor credit rating loan None of this testimony deterred industry witnesses and some House Republicans from droning on about the uniform national standards and the miracle of instant credit made possible by the federal FCRA. By early June, the Bush Administration still had not announced its position. bank credit rating The key term at issue here, investigation, is defined [by the dictionary] as a detailed inquiry or systematic examination. Thus, the plain meaning of investigation clearly requires some degree of careful inquiry by creditors, he wrote. credit card for poor credit Further, he said, the statute uses the term investigation in the context of articulating a creditor s duties in the consumer dispute process outlined by the FCRA. It would make little sense to conclude that, in creating a system intended to give consumers a means to dispute and, ultimately, correct inaccurate information on their credit reports, Congress used the term investigation to include superficial, unreasonable inquiries by creditors. We therefore hold that 1681s-2(b)(1) requires creditors, after receiving notice of a consumer dispute from a credit reporting agency, to conduct a reasonable investigation of their records to determine whether the disputed information can be verified. business credit rating MBNA also tried to argue that its investigation in Johnson s case was reasonable. But the court pointed to the specific nature of Johnson s dispute, and the testimony of MBNA agents that their investigation was primarily limited to (1) confirming that the name and address listed on the ACDVs were the same as the name and address contained in the Customer Information System, and (2) noting that the CIS contained a code indicating that Johnson was the sole responsible party on the account. moodys credit rating The MBNA agents also testified that, in investigating consumer disputes generally, they do not look beyond the information contained in the CIS and never consult underlying documents such as account applications. Based on this evidence, a jury could reasonably conclude that MBNA acted unreasonably in failing to verify the accuracy of the information contained in the CIS, he wrote. credit card with bad credit 130 Linda Johnson v. MBNA America Bank: CA-4 - No. 31-1235; Feb. 11, 2004 Richard Rubin, a Sante Fe, New Mexico attorney who argued the case for Johnson before the Fourth Circuit, noted that the panel adopted his position that had MBNA simply told the truth and stated that its investigation was inconclusive, the CRAs would have deleted the tradeline as required by the FCRA, and the litigation never would have occurred. personal credit rating Veracity - History of the Credit Bureaus and Reporting Agencies (CRA)condemned to repeat it. - George Santayana, Life of Reason, Reason in Common Sense, Scribner s, 1905, page 284 Credit bureaus had humble beginnings. These how-to sections serve as a starting point for those who are ready to oversee their own credit histories. corporate credit rating Beyond How-ToTo fully appreciate the basics, one needs to understand the larger system. To that end, Chapters 8 and 9 examine how the three major credit reporting agencies (CRAs) compile credit data on 205 million Americans, and how they and credit grantors conduct, or sometimes don t conduct, reinvestigations upon receiving consumer disputes. To help explain why credit reporting continually draws the attention of Congress, state legislators and enforcement officials, Chapter 10 traces the evolution of the industry, of the mixed files problem and other inaccuracy issues, and of identity theft. credit rating fix Chapters 11 and 12 address the controversial subjects of credit repair and debt collection. Despite the improvements, no one in Congress or elsewhere felt that the problems of credit report inaccuracy or identity theft would go away anytime soon. Some advocates predicted the problems would get worse before they got better. mortgage credit rating Chapter 22, the only entirely new chapter in this Second Edition, explores controversial policies of credit card companies that fail to report their card holders credit limits to credit bureaus, a practice that can lower credit scores. It also examines credit card companies that practice universal default, meaning they will raise card holders interest rates if their credit scores drop too much - even if they ve never had a late payment with that particular company. average credit rating PrivacyCredit scoring and credit reporting are inextricably linked to the fundamental privacy rights of consumers. As the U.S. Supreme Court has recognized, To begin with, both the common law and the literal understandings of privacy encompass the individual s control of information concerning his or her person. 11 In the Information Age, privacy is defined by, and measured according to, the principles of Fair Information Practices (FIPs). To help illustrate their plight, we will offer only a few. On November 5, 2001, retired Army Captain John Harrison, a Connecticut resident, received a call from a detective in Beaumont, Texas who was investigating a Harley-Davidson motorcycle that had been purchased using Harrison s name and SSN. The detective tracked Harrison down through his credit report. Harrison took all the steps that were recommended by experts (and the above pages in this chapter): He ordered his three credit reports, initiated fraud alerts, contacted creditors immediately, received and reviewed his credit reports, and filed a police report with the Army s Criminal Investigation Division.77 find credit rating The crook, Jerry Wayne Phillips, was caught on his Harley in North Carolina about a month later. Phillips said it was easy to convince Army officials at Fort Bragg, N.C. to issue him identification in Harrison s name and SSN. increase credit rating JoyridingFrom July to December 2001, Phillips used Harrison s identity to acquire goods, services, and cash in his name. The acquired items were valued at over $260, 000. Staying away from Harrison s home state of Connecticut, Phillips bounced from Florida to Virginia, and on to Texas, opening at least 60 fraudulent accounts: credit accounts, personal and auto loans, checking and savings accounts, and utility accounts. He purchased two trucks through Ford Credit valued at over $85, 000, and a Harley-Davidson motorcycle for $25, 000. He rented a house in Virginia and purchased a time-share in Hilton Head, South Carolina. He bounced over 100 checks on his Army and Air Force Exchange Service (AAFES) checking account. Phillips was indicted on federal charges in Texas, pled guilty to one count of identity theft, and was sentenced to 41 months in a Minnesota federal prison. credit rating uk 77Statement of Capt. One of the more difficult aspects was the 20-month struggle with credit bureaus and creditors. While Experian and Trans Union did a fair job, he charged that Equifax failed to obey the FCRA. standard poors credit rating It took eleven months and three dispute letters to get a second report from Equifax. Further, I found the report they sent to me was not the same report they were sending to creditors. On his credit report, he had 17 different addresses, six different phone numbers, and a changing date of birth, he said. credit rating numbers Credit bureaus hide behind the fact that they are only reporting what creditors tell them, while at the same time, victims are repeatedly sending affidavits, police reports, and detailed dispute letters proving the creditors are wrong.
